GPAINNOVA’s affiliate DryLyte S. L. (“DryLyte”) has started to enforce its decision previously issued by the District Court Munich I (“Landgericht München I”), Germany, with regards to the claims for injunctive relief, information, and accounting against OTEC Präzisionsfinish GmbH (“OTEC”) (court ref. 21 O 13122/23).

This action ensures that the enforced claims shall immediately be obeyed by OTEC, even during the pending appeal, further bolstering DryLyte’s position in safeguarding its proprietary technology and intellectual property.

With decision of February 5th, 2025, the District Court Munich I found that OTEC has infringed the Utility Model 20 2017 007 607 U1 in Germany.

The decision prohibits OTEC the manufacture, offer, placing on the market and use in the Federal Republic of Germany the electrofinishing devices EF-SMART and EF-PERFORMANCE used together with Micro Finishing Balls and electrolyte liquid, particularly “DL4” (attacked embodiments) when making use of claim 1 of the Utility Model 20 2017 007 607 U1, as well as to import or possess the devices for the aforementioned purposes. In addition, under German case law, the decision also covers devices and components that are core-identical to the aforementioned attacked embodiment and where the metal removal process from the part to be treated (workpiece) is being carried out mainly by the particles that have absorbed electrolyte liquid.

The decision is legally binding but yet not final as OTEC has appealed the decision of the District Court on February 28th, 2025 (court ref. of the Appeal: 6 U 659/25 e). However, DryLyte has enforced the granted claims for injunctive relief, information and accounting upon deposit of a respective security.
