The Munich Court found for infringement of a DryLyte S. L. IP-Right by OTEC Präzisionsfinish GmbH again

GPAINNOVA’ affiliate Steros GPA Innovative  S. L. (“Steros”), welcomes the  Munich Regional Court I first instance decision in favor of, DryLyte S.L., against OTEC Präzisionsfinish GmbH (“OTEC”) in relation to utility model DE 20 2017 007 610.1 “Smothing and polishing device” (“Utility Model”)  following the oral hearing on May 21, 2025, before the District Court Munich I (“Landgericht München I”), Germany (court Ref. 21 O 11216/23).

The Court ordered OTEC inter alia to refrain from manufacturing, offering, marketing, or using in Germany – or importing and possessing for such purposes – a system for smoothing and polishing metal parts by electroerosion wherein ion transport takes place through solid bodies.

The judgment specifically confirms DLyte exclusive right in Germany on systems that comprise the following:

 

  • A device for smoothing and polishing a metal part by electroerosion, wherein ion transport takes place through a solid body, comprising: 
    • a conductive element connected to a first pole of a current generator,
    • wherein the conductive element is adapted to hold the metal part to be polished,
    • a means for supplying a set of electrically charged conductive solid particles to a surface of the metal part,
    • wherein a charge of the set of electrically charged conductive solid particles is opposite to a charge of the first pole, 
  • the solids for ion transport, which are characterized in that they consist of electrically conductive solids formed by particles with porosity and affinity for absorbing an amount of an electrolyte liquid so that they have electrical conductivity, and 
  • preferably an electrolyte liquid 
  • and in particular wherein the ion transport between the anode and cathode takes place through the solids;

The decision is not yet final and legally binding as OTEC appealed the decision of the District Court. The ruling is provisionally enforceable upon provision of security; DryLyte has not yet enforced this decision.
